User Agreement

1 Acceptance of Terms

This User Agreement ("Agreement") governs your use of AssessEEZ, operated by Paradigm Qualifications Ltd. ("we," "us," or "our"), a company registered in England and Wales (Company number 14078939). By accessing or using our platform, you agree to be bound by this Agreement. If you do not agree, you must not use our services.

2 Services and Pricing

AssessEEZ provides an online platform for educational assessment and qualification management. Pricing details are available on our Pricing page. We offer one-off fee packages and monthly subscription plans, subject to the following:

• • Fair Usage Policy: Each learner is allocated an average of 5GB of data storage. For one-off fee packages, storage is provided for a maximum of 3 years. For monthly fee packages, storage is provided for the duration of the active subscription.
• • Assessors, IQAs, and EQAs: Assessors, Internal Quality Assurers (IQAs), and External Quality Assurers (EQAs) can be added at no additional cost, provided they maintain a 1:20 ratio against learners (i.e., one assessor, IQA, and EQA per 20 learners).

Pricing and package details may change. Current subscribers will be notified of changes in accordance with applicable law.

3 User Responsibilities

You agree to:

• • Provide accurate and complete information during registration and use.
• • Maintain the confidentiality of your account credentials.
• • Use the platform in compliance with applicable laws and regulations.
• • Not misuse the platform, including uploading malicious code or engaging in unauthorized access.

4 Data Protection and Security

We implement industry-standard security measures to protect your data, including encryption and access controls. However, data protection is not absolutely guaranteed. In the unlikely event of a data breach or loss, our liability is limited as follows:

• • Paradigm Qualifications Ltd. will only be liable for the total payments made by you in the preceding 3 months, or £100 if no payments have been made.
• • We are not liable for indirect, consequential, or incidental damages arising from data loss or breaches.

You are responsible for maintaining backups of your data and ensuring the security of your devices and networks.

5 Intellectual Property

All content, software, and materials on AssessEEZ are owned by or licensed to Paradigm Qualifications Ltd. You are granted a limited, non-exclusive license to use the platform for its intended purpose. You may not copy, modify, distribute, or reverse-engineer any part of the platform.

6 Limitation of Liability

To the fullest extent permitted by law, Paradigm Qualifications Ltd. and its affiliates, officers, directors, and employees shall not be liable for:

• • Any indirect, incidental, special, consequential, or punitive damages.
• • Loss of profits, data, use, goodwill, or other intangible losses.
• • Any damages arising from your use of or inability to use the platform.
• • Unauthorized access to or alteration of your data.

Our total liability for any claim arising from this Agreement or your use of AssessEEZ shall not exceed the amount paid by you in the preceding 3 months, or £100 if no payments have been made.

7 Indemnification

You agree to indemnify and hold harmless Paradigm Qualifications Ltd., its affiliates, officers, directors, and employees from any claims, damages, or expenses (including legal fees) arising from:

• • Your use of the platform.
• • Your violation of this Agreement.
• • Your infringement of any third-party rights.
• • Any data or content you upload to the platform.

8 Termination

We may suspend or terminate your access to AssessEEZ at our discretion, with or without notice, for reasons including but not limited to:

• • Violation of this Agreement.
• • Non-payment of fees.
• • Suspected fraudulent or illegal activity.

Upon termination, your right to access the platform ceases, and we may delete your data in accordance with our data retention policy.

9 Governing Law and Dispute Resolution

This Agreement is governed by the laws of England and Wales. Any disputes arising from this Agreement shall be resolved through:

• • Negotiation in good faith.
• • If unresolved, exclusive jurisdiction of the courts of England and Wales.

You waive any right to a jury trial and agree not to bring claims as part of a class action.

10 Force Majeure

We are not liable for any failure to perform our obligations due to events beyond our reasonable control, including but not limited to natural disasters, cyberattacks, or governmental actions.

11 Changes to This Agreement

We may update this Agreement from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the platform constitutes acceptance of the updated Agreement.

12 Miscellaneous

This Agreement constitutes the entire agreement between you and Paradigm Qualifications Ltd. regarding your use of AssessEEZ. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not constitute a waiver of that right.
